Web Site Hosting Terms and Conditions

The use of services from HexFF, LLC [hereafter referred to as "HexFF"] constitutes agreement to these terms. You may view our Privacy Policy here.

All services provided by HexFF may only be used for lawful purposes. The laws of the State of Michigan and the United States of America apply.

The customer agrees to indemnify and hold harmless HexFF from any claims resulting from the use of our services.

Use of our services to infringe upon any copyright or trademark is prohibited.

HexFF does not allow code not developed or approved by our employees to be hosted on our servers.

HexFF does not allow non-employee access (ftp, shell, secured or otherwise) to our web servers, mail servers, or domain servers.

HexFF will retain control of domain name registration and name server assignment during the period of time a site is hosted with HexFF. Administrative, Technical, and Billing Contacts must be assigned to HexFF. Owner Contact may be assigned to the client if desired. After termination of the hosting agreement, the domain name may be transferred to another party.

There may be an additional charge to transfer control of an existing domain to HexFF prior to a new hosting agreement.

HexFF does not refund or prorate our annual hosting fees.

You agree to supply appropriate payment for the services received from HexFF, in advance of the time period during which such services are provided. You agree that until and unless you notify HexFF of your desire to cancel any or all services received, those services will be billed on a recurring basis.

As a client of HexFF, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree that until and unless you notify HexFF of your desire to cancel any or all services received, those services will be billed on a recurring basis. Any invoice that is outstanding for 30 days and not paid may result in an account suspension until account balance has been paid in full. Access to the account will not be restored until payment has been received.

HexFF reserves the right to change the annual payment amount and any other charges at anytime.

HexFF shall not be responsible for any damages your business may suffer. HexFF makes no warranties of any kind, expressed or implied for services we provide. HexFF disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by HexFF and its employees.

HexFF retains the ownership and copyright to some components used in building client websites. Questions or considerations regarding ownership of code used in website development or copyrights should be agreed upon in writing between HexFF and the client prior to any work performed by HexFF.

HexFF reserves the right to revise its policies at any time without notice.
